Alyssha is a young lady who shared a great passion for horse riding. Unfortunately she was involved in a transport accident where she was struck by a negligent driver. Although the TAC accepted her claim at first instance, they eventually stopped funding treatment for her lower back injury. We disputed the decision and were successful at a VCAT hearing.
Although her injuries did not rate high enough to receive an impairment benefit, we believed she had suffered a serious injury. We came to this view on the basis that her lower back injury had serious consequences on her life, in particular her ability to work and ride horses.
Her application for a serious injury certificate was rejected by the TAC and again we disputed the decision by commencing litigation. After being involved in a car accident where my car was written off, the Police and fire brigaded attended and I was taken away by an ambulance, the TAC rejected my claim for a back injury.
