Alyssha is a young lady who shared a great passion for horse riding. Unfortunately she was involved in a transport accident where she was struck by a negligent driver. Although the TAC accepted her claim at first instance, they eventually stopped funding treatment for her lower back injury. We disputed the decision and were successful at a VCAT hearing.
Although her injuries did not rate high enough to receive an impairment benefit, we believed she had suffered a serious injury. We came to this view on the basis that her lower back injury had serious consequences on her life, in particular her ability to work and ride horses.
Her application for a serious injury certificate was rejected by the TAC and again we disputed the decision by commencing litigation. Prior to hearing we conducted a conference with the TAC to discuss her case. After meeting Alyssha and hearing her story, the TAC realised how much of an effect her injuries had on her life, and her serious injury certificate was granted. We were able to successfully resolve her compensation claim on the same day.
Actual Client Testimonial
After being involved in a car accident where my car was written off, the Police and fire brigaded attended and I was taken away by an ambulance, the TAC rejected my claim for a back injury. They claimed the injury was not due to the car accident but my sporting activity, horse riding. Due to this injustice, it was then that I contacted Henry Carus and Associates. To my surprise it was Henry Carus who came out to see me. Not a junior representative from the company. He explained the whole process, step by step in dealing with the TAC. He made no outrageous promises about money to be made and left us feeling secure that he actually knew what he was talking about. As a young adult and no longer able to work I relied on my parents to pay all my medical bills. This was in the thousands of dollars. The first challenge in my claim was to have the TAC accept responsibility for the treatment of my injuries from the accident. Henry and his team presented a very accurate and thorough account of the accident and I was impressed by the professionalism of the team. We came away from the hearing with our first win. Up to now, everything that Henry said was going to happen had happened. Over a five year period, we had many doctors to visit and information to supply. At all times we were kept informed and felt supported and remembered; we were not just a number. Although the process was slow, our case continued just as Henry said it would do. Eventually it came to the day when I had a pre trial meeting with the TAC. Henry and his team represented us on the day and after a few hours of whirlwind activity, the TAC made an offer. Wow! I was only expecting to go in for some talks and the team had managed to come out with an offer. I had to put all my faith in Henry and his team to negotiate the best offer possible for my circumstances. The outcome was another good win. Would I recommend Henry Carus & Associates? “Yes I would”. In the cut throat environment of litigation, you need someone you can trust. I had many offers to be represented. After my 5 year association with Henry, I leave satisfied that I got the best outcome I could. I could never have achieved the same outcome on my own as it was impossible for the average person to work through the legal nightmare and cost of chasing a just outcome. I can now get on with my life. Thankyou Henry and Eren Ozdemir.
