David was a hardworking man employed as a delivery driver who unfortunately sustained injuries to his hand in the course of his employment.

On the date of his accident he parked his truck on the premises of the Defendant to make a delivery. He had been there many times, and the normal process was for the Defendant’s forklift to remove the pallets of goods from his truck. That so occurred but in the process of doing so, the forklift jammed his index finger in such a way that it was permanently seriously injured.

Although the accident happened at work TAC eventually granted David his serious injury certificate. The TAC did so on the basis it accepted the forklift was covered by the Transport Accident Act.

Proceedings were commenced, and the matter strenuously defended on the basis that essentially David was the author of his own accident. We ended up at mediation and eventually our arguments as to liability and value of his injuries was accepted.
