The Story about this Public Liability Claim
Jana is a retired teacher with a love and passion for playing the piano and for teaching languages. She continued to tutor kids of all ages post retirement.
On the date of accident Jana had just dropped off her car for servicing and as it was a lovely day she had a tendency to go for a stroll back home. On her way home she was approaching a construction site with an uneven gravel surface with no signage warning pedestrians of the footpath. As she was crossing this surface she tripped and fell hurting her left shoulder and right wrist in the process. The left shoulder and wright wrist continue to cause her a lot of discomfort. Jana was a very fit and active lady before the accident able to perform most duties. Distraught by not being able to play the piano how she used to or to work on her garden which she loved she wanted to get some legal advice.
She approached a large law firm for assistance and guidance on a potential compensation claim and was politely told “it is too hard to win for you”. Jana did not want to take it any further until hearing about our firm and making an appointment to see us. We advised her that we are very able to assist and that we would get to work immediately. The legal process commenced and the Defendant contested the matter at every point stating that there was a warning sign and that all necessary check on their part were completed. They said it was just ‘an unfortunate accident’ showing a picture they had taken on the day to support their position. That photo seemed to show the surface as “level” and “safe”. Our firm also obtained photos of the accident site shortly after the accident and we said that the photo we have is a better indication of how the accident site looked on the date of the accident. We were firm in our views that our client’s story will be believed and that our evidence is consistent.
After hours of negotiations the Defendant agreed to pay Jana $90,000.00 for her accident.
