The Story about this Public Liability Claim

Jill came to see us after suffering a nasty slip and fall injury whilst on holiday with her partner. The accident occurred at a coastal town in Victoria where Jill, an avid sailor, had decided to take a walk along the jetty to view the boats.

Unbeknownst to Jill, the surface of the jetty had several smooth metal strips that became extremely slippery when wet. On this day, it had been raining and despite her partner’s best efforts to break her fall, Jill slipped on the metal strips, seriously injuring her ankle.

Our investigations revealed that the jetty manager was aware of the risk and was, in fact, trialling a non-slip treatment on the metal strips at the time of Jill’s accident. Sadly, it was to no avail, and Jill slipped on the untreated part of the surface.

We were successful in arguing that it was totally unacceptable to conduct this slip resistance trial on the public, especially when the manager knew how dangerous the metal strips were.
