The Story about this TAC Claim

Jin Chuan Deng is a 83 year old man who was enjoying his retirement life with his wife. On the evening of his accident, he had been playing some Mah-Jong at his neighbour’s house. On his way home, he was crossing a small road. He was just a few steps away from the kerb when he was struck by a car. The driver did not even brake, stop, or render him any assistance, and just fled the scene. As a result of the accident, he suffered multiple injuries including head, neck, and back injuries. He did not think he was able to get compensation, as it was a hit and run.

Our Eliza Tan visited him at his home and attended the accident site.  It was clear to us that the accident was the unidentified driver’s fault, who will be indemnified by the TAC. The TAC granted him a Serious Injury Certificate. With that, we pursued a common law claim against the TAC. We managed to settle the claim without going to Court, with a very good result.

Here is what Jin Chuan’s son has to say about the matter.

Dear Henry Carus & Associates,

First of all, I would like to say thank you to solicitor Eliza and her assistant Miss Amy of your firm.

On 16 September 2017, my father was hit by a car when he was crossing the road on his way home from a neighbour’s house. At the time, my father was over 80 years old.  The offending driver did not stop and ran away from the scene, leaving my father lying in the middle of road with non-stopped bleeding. Later a passer-by called an ambulance and sent my father to Royal Melbourne Hospital for emergency treatment.

After the accident, we did not take much actions, and the police could not find the offending driver either. It was at that helpless moment when Eliza took the initiative to visit us at home, and advised us that she can seek compensation for my father through legal action.

Initially I was in hesitation, but Miss Amy assured me that if they do not win compensation for my father, they would not charge a cent. I then decided to give it a try.

After about 1 year and a half, they successfully won a fair sum of compensation for my father. During the course of the claim, they have done a large amount of the detailed investigation and research work. My father suffered brain injury from the accident and he was not sound in mind for quite a long time. In order not to disturb my father, they would rather do more work by themselves.

No words can express my gratitude. This is not just about the money, but rather a great comfort to our mind and soul. Imagine how one would feel when he was in right, but could not speak for himself, did not know where to seek justice and how to achieve it?
