The Story about this TAC Claim
Kapiti was involved in a motor vehicle accident in July 2009. The vehicle at fault for the accident was unknown as the driver fled the scene following the accident.
Kapiti came to Henry Carus and Associates when one of the large firms told him they did not think the court would find he had a serious injury as a result of injuries he sustained.
An application had been made to the TAC for a serious injury certificate and the request was denied. On behalf of Kapiti, we issued proceedings in court asking a judge to grant him a serious injury certificate. At a conference right before the hearing, the TAC said we should withdraw the proceedings as we were going to lose. We said no.
The court heard the matter and the judge granted Kapiti a serious injury certificate within days, allowing him to sue the driver at fault.
Even though the vehicle could not be identified the TAC must indemnify all unidentified vehicles and as such was responsible for the driver that injured Kapiti.
We commenced common law proceedings seeking compensation for Kapiti and achieved just that.
Within a reasonable time, the TAC made Kapiti an offer which we recommended and Kapiti finally received the compensation he deserved for his serious injuries.
