Mary came to see us after suffering a life-changing injury at work. Her employer, a major global stevedoring company, informed her of a damaged shipping container on the wharf and told Mary to go and inspect it.

As she was conducting her inspection, another worker opened the door retaining the contents of the container, and in an instant, more than 10 tons of wheat spilled out and over Mary.

Mary thought she was going to die. Fortunately, she survived the accident, but was left with nasty lower limb injuries, requiring surgery for a total knee replacement which resulted in a very poor recovery.

Mary now ambulates with a significant limp and is unable to walk without a cane. She also still struggles with the psychiatric consequences of what happened to her, including her near-death experience.

Our investigations revealed that not only was the staff member that opened the door inexperienced and untrained, but he did so against the direct instruction of another, more experienced, colleague. WorkSafe also investigated the accident and issued the employer with an improvement notice for various breaches regarding its policies and procedures in dealing with damaged shipping containers.

Even though Mary was almost 66 years of age at the time, we were able to settle her matter with her receiving over $1.15m in total compensation for her pain and suffering and loss of earnings.
