The Story about this Public Liability Claim

Rachel called us to visit her at her home, as she had an injury to her foot and was finding it very difficult to walk around. Henry went out to visit her, and met her and her husband and heard her story of how at a home and garden supply store a worker had dropped a load of cement bags onto her foot. It was clear to Henry that the worker and the store who employed him was at fault, but prior experience with the insurer of this store meant that we had our homework to do. We immediately went out with Rachel to the accident site, and Henry got a complete run down of what happened and his views on liability remained, with no responsibility whatsoever on Rachel. We waited and when Rachel did not recover we started the litigation process. As expected, the insurer for the store started to create one argument after another to avoid responsibility and so it continued all the way up to the mediation shortly before the trial. Finally, the senior barrister the insurer briefed conceded there was no doubt the worker was totally and solely at fault. Sadly, the battle shifted to the value of the claim, and though we cannot give the details the values offered – from the first offer made to the time it was finally settled, the amount of compensation Tripled.  What Rachel needed all the way through was the support of our firm that we were not willing to give up for her – that she Deserved More.
