The Story about this Public Liability Claim
Vera came to our office distressed, not as someone who had been injured, but as someone who needed defending from a personal injury claim.
She had been sued by her godgranddaughter who suffered injury at her apartment.
On the day of the incident, Vera’s godgranddaughter visited Vera’s apartment. Her mother had brought her there, along with her brother.
The two children were playing in Vera’s courtyard, while their mother was chatting inside the apartment. Vera was making coffee.
Whilst playing, the brother pushed a pillar with a pot on top of it, and the godgranddaughter’s hand got caught between the pot and pillar.
Vera was uninsured and she was at risk of losing her home if her godgranddaughter won the case.
Vera was recently widowed, financially stressed and depressed.
She was at a loss as to what to do.
She had been looking for a lawyer to defend her as an uninsured defendant, and her financial situation meant she needed the legal fees to be kept as low as possible.
Upon taking her instructions, we strongly defended her claim.
We formed the view that the godgranddaughter’s mother was responsible for the accident and we joined her as a third party to the claim.
We were successful in getting the godgranddaughter to withdraw the claim.
Vera’s daughter has the following to say:
Actual Client Testimonial
My recently widowed mother was forced to defend herself when her goddaughter of 44 years falsely accused her of negligence. My mother spent over one year being bullied by her godchildren and felt completely helpless. Many lawyers were quick to turn her away claiming she was a defendant, and as such, taking on her case would be of no benefit to them financially. After a desperate plea on Facebook seeking assistance, a wonderful lawyer reached out and put us in contact with Henry Carus. In one phone call to Henry Carus + Associates, our lives changed. We met with Henry and his staff who listened and provided my scared and distraught mum with much needed support. My mother's godson is a lawyer and I'm sure they hoped that mum was cornered and forced to oblige with their request for money until they received notification from Henry carus with a counterclaim. That all it took for them to see that Mum's case was taken seriously as were their false accusations and hens withdrew their claim.
As a widower on a pension, Henry was more than reasonable with his fee and he even met mum at her home so that he can have a better understanding and visual of the accident that occurred many years ago. Mum was thrilled to be able to spoil Henry and his team with homemade traditional food.
When nobody would help us we were blessed to meet a gem. We will forever be grateful to Henry and his team.
